Bear Kuusamo Ltd/Karhu-Kuusamo Oy
1. Scope and Applicability
These terms and conditions apply to all services and excursions provided by Bear Kuusamo Ltd/Karhu-Kuusamo Oy (“the Service Provider”) to consumers as defined in the Finnish Consumer Protection Act (38/1978).
By making a reservation and completing payment, the customer accepts these terms, which become binding on both parties.
2. Reservations and Payment
The service provider is Bear Kuusamo Ltd/Karhu-Kuusamo Oy.
All prices include value-added tax (VAT) in accordance with Finnish law.
The person making the reservation must be at least 18 years of age and is responsible for ensuring that all participants comply with these terms.
Reservations are primarily made through the online booking system on the Service Provider’s website. Bookings may also be made by telephone or email.
Payment is required at the time of booking and may be made:

via the online store (https://bearkuusamo.com/booking/), with a card or
-
on-site by cash.
If you are paying by cash, we request that you reserve an even sum.
Employer-provided benefit scheme (Epassi) is also accepted where applicable.
Online payments are processed by Bokún Inc. in cooperation with credit institutions. Karhu-Kuusamo Oy/Bear Kuusamo Ltd does not store or have access to customers’ credit card details.
3. Right of Withdrawal
In accordance with Chapter 6, Section 16 of the Finnish Consumer Protection Act, the statutory 14-day right of withdrawal does not apply to leisure services provided on a specific date or within a specific time period.
4. Cancellation and Changes by the Customer
Cancellations must be submitted in writing by email to bear@bearkuusamo.com.
The reservation may be transferred to another date free of charge, subject to availability.
Cancellation fees are as follows:

Cancellation 4–2 days before the event: 50% of the total price

Cancellation less than 2 days before the event: 100% of the total price
If the cancellation is due to a compelling reason beyond the customer’s control (such as sudden illness or accident), no cancellation fee will be charged, provided that the reason can be reasonably verified.
5. Changes and Cancellations by the Service Provider
Bear Kuusamo Ltd/Karhu-Kuusamo Oy reserves the right to adjust the duration, content, or route of the programme if necessary for safety reasons or other compelling circumstances, such as adverse weather conditions.
The service may be suspended or cancelled if a participant’s actions endanger their own safety, the safety of others, or the execution of the programme. In such cases, no refund is made if the cancellation is attributable to the customer’s conduct.
6. Force Majeure
Bear Kuusamo Ltd/Karhu-Kuusamo Oy is not liable for failure to perform or delays caused by force majeure or unforeseeable circumstances beyond its reasonable control. These include, but are not limited to, natural disasters, extreme weather conditions, strikes, pandemics, or significant road disruptions.
In the event of cancellation due to force majeure, the customer is entitled to either:

reschedule the excursion free of charge, or

receive a refund of any advance payment made.
7. Insurance and Liability
Bear Kuusamo Ltd/Karhu-Kuusamo Oy holds valid liability insurance covering damages caused by negligence attributable to the Service Provider.
Customers participate in excursions at their own risk and are required to have valid personal travel and accident insurance covering the activity.
Bear Kuusamo Ltd/Karhu-Kuusamo Oy shall not be liable for any damages resulting from risks inherent to nature-based activities, except where required by mandatory consumer protection legislation.
8. Applicable Law and Dispute Resolution
These terms are governed by the laws of Finland.
In the event of a dispute, the parties shall first seek an amicable resolution. If no agreement is reached, the consumer may refer the matter to the Consumer Disputes Board (Kuluttajariitalautakunta) or bring the case before a competent Finnish district court.
